Rental Terms and Conditions

These terms govern the reservation and rental of vehicles offered by Royalrent Marbella through the website https://rentalcarmarbella.es and through other authorised communication channels.

2. Driver Requirements

• The driver must be of legal age and legally authorised to enter into contracts.
• The driver must present a valid identity document or passport.
• The driver must present a valid driving licence.
• Royalrent Marbella may require a minimum driving licence holding period depending on the reserved vehicle.
• Royalrent Marbella reserves the right to refuse vehicle delivery if the documentation is invalid, incomplete or does not match the reservation details.

3. Reservation and Confirmation

Reservations made through the website are subject to actual vehicle availability, data verification and confirmation by Royalrent Marbella. The automatic receipt of an order or request does not necessarily imply final acceptance of the rental until it has been reviewed and confirmed.

4. Prices, Payments and Charges

• Prices are displayed in euros and include the concepts indicated during the reservation process.
• Rental prices may vary depending on the vehicle, duration, dates, availability, additional services and specific conditions.
• If the customer chooses payment upon vehicle collection, a €30 cash payment management fee may apply and will be displayed during the booking process.
• Outstanding amounts must be paid before or at the time of vehicle delivery, depending on the agreed payment method.
• Royalrent Marbella may reject a reservation in case of obvious pricing, availability or technical configuration errors.

5. Security Deposit

For certain vehicles, a security deposit will be required. The amount will be indicated during the reservation process or before vehicle delivery. The deposit is intended to cover possible damages, delays, extraordinary cleaning, missing fuel, fines, administrative charges, lost keys, contractual breaches or other amounts arising from the use of the vehicle.

The deposit will be returned in full or in part once the vehicle condition has been verified and provided that there are no outstanding charges. If damages or pending amounts are detected, they may be deducted from the deposit without prejudice to claiming higher amounts when applicable.

6. Insurance and Coverage

Vehicles include the legally required insurance coverage. Specific insurance conditions, deductibles, exclusions and customer liability may vary depending on the vehicle and will be communicated before or at the time of rental.

Unless expressly agreed otherwise, damages caused by negligent use, driving under the influence of alcohol or drugs, unauthorised drivers, misuse of the vehicle, serious traffic violations, damage to the underbody, tyres, rims, windows, interiors, loss of keys or any situation excluded by the insurance policy or these terms will not be covered.

7. Permitted Use of the Vehicle

• The vehicle must be used responsibly and in accordance with current traffic regulations.
• Participation in races, competitions, speed tests or unauthorised sports driving is prohibited.
• Subletting, transferring or allowing the use of the vehicle by unauthorised persons is prohibited.
• The use of the vehicle for illegal activities, transportation of dangerous goods or purposes not agreed upon is prohibited.
• The vehicle may not leave Spain without prior express authorisation from Royalrent Marbella.

8. Vehicle Delivery and Return

Vehicle delivery and return shall take place at the agreed location, date and time. The customer must inspect the vehicle upon delivery and report any visible damage before use.

Late returns may result in additional charges. If the delay affects subsequent reservations or causes operational inconvenience, Royalrent Marbella may claim the corresponding costs.

9. Fuel, Cleanliness and Vehicle Condition

• The vehicle must be returned with the fuel level agreed upon at delivery.
• If returned with less fuel, refuelling costs and a management fee may apply.
• The vehicle must be returned in reasonably clean condition.
• Additional charges may apply for extraordinary cleaning, stains, persistent odours, excessive sand, waste, damaged upholstery or dirt beyond normal use.
• Smoking inside the vehicle is prohibited. Failure to comply may result in cleaning and deodorising charges.

10. Fines, Tolls and Penalties

The customer shall be responsible for fines, penalties, tolls, parking charges, traffic violations or any other charges incurred during the rental period. Royalrent Marbella may charge the customer the corresponding amounts as well as administrative management fees.

11. Accidents, Damage or Incidents

In case of accident, damage, theft, loss of keys, breakdown or any incident, the customer must immediately inform Royalrent Marbella and follow the provided instructions. In the event of an accident, an accident report must be completed when applicable and authorities contacted if necessary.

Failure to communicate immediately, concealment of damage or failure to follow instructions may affect applicable coverage and generate additional liability for the customer.

12. Cancellations, No-Shows and Modifications

Cancellations, modifications or refund requests are governed by the Cancellation and Refund Policy published on this website. In case of customer no-show at the agreed date and time, Royalrent Marbella may consider the reservation as a no-show and apply the corresponding conditions.

13. Vehicle Availability and Replacement

Royalrent Marbella will make every reasonable effort to provide the reserved vehicle. However, due to operational reasons, breakdowns, accidents, delayed previous returns or other justified causes, an equivalent or similar category vehicle may be offered whenever possible.

14. Data Protection

Customer personal data will be processed in accordance with our Privacy Policy available on this website. Information may be used to manage reservations, contracts, payments, deposits, communications, incidents, legal compliance and customer support.

15. Applicable Law and Jurisdiction

These terms are governed by Spanish law. For any dispute, the parties shall submit to the competent courts and tribunals in accordance with applicable consumer protection regulations.
